If a patient in a nursing home in Pennsylvania dies because of the home staff's negligence, the patient's family members have the right to take legal action. One nursing home resident recently passed away in another state after reportedly falling down several times. A nursing home neglect lawsuit has thus been filed against the facility.
According to the complaint, a woman, 76, entered the nursing facility in 2014. The plaintiff said the nursing home knew that the woman had a high fall risk and was suffering from Alzheimer's dementia. The plaintiff also reported that an alarm that was frequently inoperable was installed on the resident's bed.
The facility is accused of allowing the woman to fall on four separate occasions; the plaintiff said the woman was incapable of alerting the staff when the falls occurred. One day, the woman was reportedly discovered face-down, and she was unresponsive and bleeding. A couple of days later, she was pronounced deceased. The nursing home is accused of abusing and neglecting the woman by not providing her with appropriate supervision and not keeping her in sight.
In the nursing home neglect suit, the nursing facility is also blamed for not providing the resident with an appropriate alarm system and not making sure that the alarms were working properly. The plaintiff further said that the facility did not create a plan of care that was up to date. The nursing home recently sought for the lawsuit to be transferred to a different county from where it was filed, specifically, to the county where the reported wrongful acts took place. Damages totaling over $50,000 are being sought. It is within the rights of any person in Pennsylvania to seek justice via the legal system against a nursing home facility that failed to properly care for his or her loved one.
